By using this Site, you agree to this privacy policy and terms and conditions of use (the “Terms”); if you do not agree, you may not use the Site. This Site is only permitted to be used by individuals working in the health care industry. If you are not in the health care industry, you should not use this Site. In using this Site you agree that you will not share any Protected Health Information (as defined by the Health Insurance Portability and Accountability Act of 1996, “HIPAA”), Trek Health may modify the Site and/or these Terms from time to time without notice to you, except that if Trek Health makes material changes to these Terms, we will post the revised Terms and the revised effective date on this Site and/or provide notice by some other means. By using the Site following any modifications to the Terms, you agree to be bound by the modified Terms.
1. Use of the Site
You must be at least 18 years old to use our Site. You will comply with all applicable laws, rules and regulations in connection with your use of the Site. You will not violate or attempt to violate the security of the Site or Trek Health’s systems or network security, including, without limitation by (i) accessing data not intended for users of the Site or gaining unauthorized access to an account, server or any other computer system; (ii) attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures; (iii) attempting to interfere with the function of the Site, host or network. You may not “crawl,” “scrape,” or “spider” any portion of the Site (through use of manual or automated means).
2. Information Not Confidential
If you choose to contact any Trek Health personnel using the contact information or information submission features you find on the Site, you understand any information and/or materials you provide to such personnel will not be treated as confidential or proprietary. Trek Health undertakes no obligation to review information submitted by you, or to return such information to you. Trek Health may receive information that is similar to information you submit, or may have already received information containing ideas and plans that are the same as or similar to ideas and plans contained in information you submit to Trek Health. Nothing you submit to Trek Health will cause it or its affiliates to be limited or restricted from the pursuit of any opportunities, either alone or with third parties.
3. Trek Health Proprietary Rights
The Site, including all of its contents (including, text, images, audio, and the HTML used to generate the pages) (“Content”), are the property of Trek Health or that of our suppliers or licensors and are protected trademark, copyright, and/or other intellectual property laws. You may not download, copy, print, display, perform, reproduce, publish, modify, prepare derivative works from, license, transmit, or distribute any Content from this Site in whole or in part, for any public or commercial purpose without prior written consent from Trek Health. Trek Health grants you a limited, personal, non-exclusive, non-transferable license to access the Site, and to use the Content, solely for personal, internal and non-commercial purposes. Trek Health (on behalf of itself and its suppliers and licensors) reserves all rights not expressly granted herein.
Without limiting the foregoing, as between you and Trek Health (or other companies whose marks appear on the Site), Trek Health (or the respective company) is the owner and/or authorized user of any trademark, registered trademark, logo, and/or service mark appearing on the Site (the “Marks”). Nothing on the Site should be construed to grant any license or right to use any Trek Health Mark. You may not use or exploit any Marks without prior written consent from Trek Health.
4. Artificial Intelligence Technologies
Some of the Site or components thereof may be powered by artificial intelligence (“AI”), including the use of non-human tools, platforms and/or other technology powered or made available in connection with the use of generative AI or machine learning models (“AI-Powered Technology”). Anything you post, upload, share, or otherwise provide through the AI-Powered Technology is your “User Submission.” By submitting User Submissions through the AI-Powered Technology, you hereby do and shall grant Health Trek a right to use the User Submissions to provide, maintain, develop and improve our Site, comply with applicable law, enforce our terms and policies and keep our Site safe. You represent and warrant that you have all rights to grant such licenses to us without infringement or violation of any third party rights, including without limitation, any privacy rights, publicity rights, copyrights, trademarks, contract rights, or any other intellectual property or proprietary rights and that all User Submissions submitted by you are in compliance with all applicable laws, rules and regulations. You are solely responsible for all User Submissions you contribute to the AI-Powered Technology. You agree that you will not post, upload, share, store, or otherwise provide through the AI-Powered Technology any User Submissions that: (i) contain any Protected Health Information (as defined by the Health Insurance Portability and Accountability Act of 1996, “HIPAA”), (ii) infringe any third party's copyrights or other rights (e.g., trademark, privacy rights, etc.); (iii) contain sexually explicit content or pornography; (iv) contain hateful, defamatory, or discriminatory content or incite hatred against any individual or group; (v) exploit minors; (vi) depict unlawful acts or extreme violence; (vii) depict animal cruelty or extreme violence towards animals; (viii) promote fraudulent schemes, multi-level marketing (MLM) schemes, get rich quick schemes, online gaming and gambling, cash gifting, work from home businesses, or any other dubious money-making ventures; or (ix) that violate any law. Your use of the Site may result in outputs from the AI-Powered Technology, including any text and images that are elicited directly or indirectly by, or otherwise made available to, you in connection with the User Submissions you provide through the Site (“Outputs”). You acknowledge that the use of the Site by us or others may generate the same or similar Outputs and that does not violate any rights you may have. To the extent you own or acquire any intellectual property rights in an Output, such Output will be deemed a User Submission and subject to the same licenses granted above with respect to all other User Submissions. Please note that all of the above licenses are subject to the Privacy Policy below to the extent they relate to User Submissions that are also your personally-identifiable information.
Though the AI-Powered Technology may be used in connection with the Site and results thereof, the AI-Powered Technology is for research use only. The AI-Powered Technology is not intended for, and may not be used for, diagnostic use or informing clinical decisions. Without limiting the foregoing, neither the AI-Powered Technology, nor the use thereof or of any Output generated thereby, is a product of clinical laboratory services nor has the AI-Powered Technology or such use or data been validated or assessed following CLIA, CAP or FDA regulatory guidelines. You acknowledge that Outputs may contain errors and misstatements and may be incomplete or inaccurate. Before leveraging any Outputs, you are responsible for making your own determination that the Outputs are suitable, and you are solely responsible for any reliance on the accuracy, completeness, or usefulness of any Outputs. We cannot control and have no duty to take any action regarding how you may interpret and use the Output or what actions you may take as a result of having been exposed to the Output, and you hereby release us from all liability for any Output provided through the Services. You should not act or refrain from acting on the basis of the Outputs. We make no representations or warranties regarding any Outputs, which are provided “AS IS” and should be accessed and used at your own risk. Health Trek will not be liable in any way for any Outputs or for any loss or damage of any kind incurred as a result of your interaction with the Services or any AI-Powered Technology. You agree to defend, indemnify and hold harmless Health Trek with respect to any claims, damages or liability related thereto.
5. Links from and to the Site
The Site may contain links to third party websites (“Third Party Sites”). Third Party Sites are not reviewed, controlled or examined by Trek Health in any way and Trek Health is not responsible for any content contained therein. These links do not imply Trek Health’s endorsement of or association with any Third Party Site. Trek Health is not liable, directly or indirectly, to anyone for any loss or damage arising from or in connection with use of the Third Party Sites. If you click on a link to a third-party website or service, a third party may also transmit cookies to you. These Terms do not cover the use of cookies by any third parties, and we aren’t responsible for their privacy policies and practices.
6. Disclaimer of Warranties
THE SITE, INCLUDING, WITHOUT LIMITATION, THE AI-POWERED TECHNOLOGY, ALL CONTENT AND FUNCTIONALITY THEREOF, IS PROVIDED “AS IS,” WITHOUT WARRANTY OF ANY KIND, INCLUDING, WITHOUT LIMITATION, ANY WARRANTIES OF AVAILABILITY, ACCURACY, COMPLETENESS, USEFULNESS, TITLE, NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, AND TREK HEALTH (ON BEHALF OF ITSELF AND ITS SUPPLIERS AND LICENSORS) HEREBY DISCLAIMS ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED. NO ADVICE, RESULTS, INFORMATION OR MATERIALS, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU THROUGH THE SITE WILL CREATE ANY WARRANTY NOT EXPRESSLY MADE HEREIN.
7. Limitation of Liability
TO THE GREATEST EXTENT PERMITTED UNDER APPLICABLE LAW, IN NO EVENT WILL TREK HEALTH, ITS AFFILIATES OR ANY OF ITS OR THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS OR LICENSORS (THE “TREK HEALTH PARTIES”), BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES ARISING FROM OR IN CONNECTION WITH THE USE OF, OR THE INABILITY TO USE, THE SITE OR THE CONTENT, EVEN IF ANY TREK HEALTH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN NO EVENT WILL THE TOTAL LIABILITY OF ANY TREK HEALTH PARTY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT OR TORT, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE OR OTHERWISE) ARISING FROM OR RELATED TO THE TERMS, THE CONTENT, AND/OR YOUR USE OF THE SITE, EXCEED, IN THE AGGREGATE, $100.
8. General Information
These Terms are governed by the laws of the State of Delaware, without regard to the conflicts of laws provisions thereof. In the event of any dispute arising in connection with these Terms, you hereby consent to exclusive jurisdiction and venue in the state and federal courts of San Mateo County, California. The failure of Trek Health to exercise or enforce any right or provision of these Terms does not constitute a waiver of such right or provision. If any provision of these Terms is found by a court of competent jurisdiction to be invalid, that provision will be limited or eliminated, to the minimum extent necessary, so that these Terms shall otherwise remain in full force and effect and enforceable. You may not assign these Terms or transfer any of your rights or obligations hereunder without Trek Health’s express written consent. These Terms inure to the benefit of Trek Health’s successors, assigns and licensees. These Terms are the entire agreement between you and Trek Health with respect to the subject matter herein.
9. Privacy Policy
9.1. This Privacy Policy covers how Trek Health collects and processes data that identifies or relates to you (“Personal Data”). This Privacy Policy does not cover the practices of companies we don’t own or control or people we don’t manage.
9.2. Personal Data We May Collect
Device or Web Data. If you interact with us online (e.g., by visiting the Site), we may collect information about your device and/or browser such as your IP address, IP address-based location data, device ID, and type of device or operating system used to connect with us.
Contact Data. If you sign up for a demo, subscribe to our newsletters or other communications, or otherwise indicate interest in our services, we may collect your contact information such as your name, email, phone number, employer, and job title.
Other Personal Data. We may collect other Personal Data that you make available through the Site or to us, such as through User Submissions, in emails, letters, texts, or other communications you send us.
9.3. Sources of Personal Data
From You. We collect Personal Data when you provide it directly to us (e.g., when you contact us or upload User Submissions). We also collect certain Personal Data (such as Device or Web Data) automatically when you use our Site (e.g., through Cookies – as defined in the “Cookies” section below), or if you download or install an application as part of our Site.
Public Records. We may collect Personal Data from public sources.
Third Parties. We may collect Personal Data from third parties such as vendors that provide analytics on how you interact an engage with our Site, the services we offer, or that help provide you with customer support. We may also use vendors to help generate leads.

9.11. Nevada Resident Rights. If you are a resident of Nevada, you have the right to opt-out of the sale of certain Personal Data to third parties. Please note that we do not currently sell your Personal Data as sales are defined in Nevada Revised Statutes Chapter 603A.
